Were you “shocked and surprised” letter sent to Burning Tree South lot owners

Burning Tree South lot owners knew the covenants state that they could only be assessed for actual upkeep, repair and maintenance of property in Burning Tree South and  there never has been any property owned by Burning Tree Area #4 Association, Inc.

HOW DID LOT OWNERS FIND OUT WHAT A FEW OTHER LOT OWNERS HAD DONE?

Most homeowners in Burning Tree South were not even aware that a  homeowners association had been formed until they received a letter, in January 1979, sent from the brand new Burning Tree Area #4 Association, Inc. In the newsletter it asked “Were you shocked and surprised to learn that YOU belong to a homeowners association? Were you equally shocked at being assessed for expenses for this homeowners association? If you were shocked or if you were aware of these developments, you should be interested in attending the first post-incorporation meeting of Burning Tree Area #4 Association, Inc. to be held at 7:00 p.m. in the Union High School, Choir Room on February 6, 1979.

It is important to remember that Attorney/Burning Tree South homeowner/President of the BTMA Frank Spiegelberg advised in May 1981 that it is not the homeowners who are the members.
